Marriage in Islam

In Islam, matrimony is a sacred, legally binding contract called nikah. It is highly encouraged as a means of completing half of one’s faith, finding companionship, and establishing a family. It is not a sacrament, but rather a formal agreement that outlines the rights and responsibilities of both spouses.

Essential conditions for a valid Islamic marriage

Offer and acceptance (Ijab-o-Qubool): Both the prospective bride and groom must give their free and explicit consent to the marriage. Forced marriages are strictly invalid in Islam. In traditional settings, the bride’s consent is secured through her legal guardian (wali).

The wali (guardian) for the bride: In most Sunni schools of thought, a bride must be represented by a male guardian, who is typically a close male relative like her father, grandfather, or brother. The wali ensures the marriage is in the bride’s best interest and is not an invalid union. The Hanafi school of thought is a notable exception, allowing an adult woman to contract her own marriage. Shia Islam also does not require a wali.

Two Muslim witnesses: The marriage contract must be witnessed by two sane, adult, and trustworthy Muslim men. Alternatively, one man and two women can serve as witnesses. This public declaration helps to prevent hidden or secret marriages, which are considered invalid.

The mahr (dowry): The groom must present a mandatory gift to the bride, which is her exclusive property and provides her with financial security. The mahr is not a bride-price paid to her family, and its value is mutually agreed upon by the couple. It can be paid immediately, deferred to a later date, or a combination of both.
